[(Prompted by law exam withdrawal, and by a newbie coworker at the Cute Vic (where we're all getting a little sick of Christmas music over the lobby loudspeakers), who asked, "who exactly WAS Parson Brown?")] [QUESTION I. The lyrics of "Walkin' In A Winter Wonderland." For the purposes of the exam, assume the following: "the lane" in which "the snow is glistening" is privately owned, with easements exclusively among the landowners using it; the lovers do not own land on "the lane"; "the snow" is "glistening" because of radiocative fallout from the neighboring Wonderland Nuclear Power Plant, which is partly financed by state and Federal government funds; title to the part of "the meadow" where the lovers built "a snowman" is clouded: it might be part of the remnant of the old Wonderland community park (parcels of which were divided and sold off to private owners during Wonderland's 1970s budget crisis, leaving a small portion still in public hands), or might be privately owned; the lovers' delusion that "the snowman" was "Parson Brown" was caused by the radioactivity of the snow; unbeknownst to the lovers, the REAL Parson Brown was lurking behind a nearby Douglas fir (which is definitely on public land), plotting to influence conservative Christian members of Congress to pass legislation allowing any clergyman to accost strangers and ask about their marital status; the lovers "dream by the fire," after a bowl of high-grade hairy purple bud (the state in which Wonderland sits passed a medical marijuana initiative in 1999, although neither lover has a doctor's prescription for pot); and while the facts do not state the crime in question, and "to face unafraid/the plans that we made" is not listed in the state's penal code, the lovers "conspire."
